Perficient takes privacy seriously. We value the trust individuals visiting our websites or viewing our marketing activities (“you”) place in Perficient when sharing your Personal Information with us and strive to be transparent with you about what Personal Information we collect, what we do with it and with whom we share it. This Privacy Policy ("the Policy") describes the type of information Perficient, Inc. and its affiliates worldwide (“Perficient” or “we”) may collect from you, how and why it’s collected, and your associated rights.

The Policy applies to individuals who contact Perficient by phone or electronically, visitors to Perficient’s website www.perficient.com (the “Website”), and other individuals who interact with Perficient in connection with its professional services, marketing activities, applications for employment, and portions of this Policy may also apply to certain Perficient employees depending on where they reside. This Policy also applies to advertisements for Perficient’s products and services, which Perficient (or a service provider acting on our behalf) may direct you to via third-party websites, platforms, and applications.

TYPES OF PERSONAL INFORMATION COLLECTED

The term “Personal Information” as used in this Policy means information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household.  Personal Information does not include de-identified, aggregated or anonymized information that is maintained in a form that is not capable of being associated with or linked to you or publicly available information from government records.  Examples of Personal Information Perficient typically collects include name and title; contact information such as email address, phone number, mailing address; and information about your current employer. 

We may collect other types of Personal Information such as:

  • Communications with You. We may collect information you provide us when you contact us via our Website, or by email, phone or mail. We may also collect Personal Information when you enter a promotion including but not limited to your contact information, photos, videos and other user-generated content that you submit.
  • Social Media Information. In addition to Personal Information you may post on our social media pages, we may also collect your social media profile information and Personal Information posted on your page, including: profile picture, network, gender, username, user ID, age or age range, language, country, friends list, follower list, and any other information you have agreed it can share or that the social network provides to us.
  • Employment Information. If you apply for a job with us or are hired as an employee, we collect Personal Information that you include in your application as well as other information needed to begin employment such as the name and address of your current/past employer(s), your employment and educational history, and possibly other characteristics of protected classifications under California or federal law, such as gender.
  • Device Information. We may collect the identity of the type of device you use to access our Website (e.g., device identifier, IP address or mobile operating system.)
  • Location Information. We may collect precise location information from your device (e.g., your exact location when you access our Website or information that allows us to approximate your location).   • Log and Analytics Data. We may collect information about the browser you are using when visiting our Website as well as what site you came from, or what site you visit when you leave our Website.
  • Inferences.  We may collect inferences about your preferences, characteristics, behavior and attitudes.

HOW WE COLLECT YOUR PERSONAL INFORMATION

Perficient may collect your Personal Information in one or more of the following ways:

Directly From You. When you:

  • Sign up to receive marketing communications or register to download white papers or other similar research materials
  • Register for a webinar, event or live conference sponsored by Perficient
  • Respond to a survey
  • Contact us on our Website, via email, phone or by mail
  • Interact with Perficient social media pages
  • Apply for a job with Perficient or based on your employment with Perficient

Automatically. When you:

  • Visit our Website on any device
  • Click on a Perficient sponsored link or third-party advertisement on another platform or website
  • Open an email from Perficient
  • Through the use of tracking technologies such as cookies, pixels, Flash objects, APIs and mobile software development kits (SDKs) including the use of third-party services to collect this Personal Information when you use our Website. From Third Parties. We may receive Personal Information about you from other sources including:

  • Our business partners, including online advertising networks, analytics vendors, and companies that co-sponsor our promotions.
  • Social media platforms, including Facebook (Meta), Instagram, Twitter, YouTube, LinkedIn, and TikTok. The information we receive from these social media platforms is dependent upon the social media platform’s policies and your settings on that site.
  • Referrals from colleagues and other third parties who may share your Personal Information with us because they think you may be interested in our services.
  • External resources such as telephone directories, newspapers, internet sites, public records, and commercially available data resources.
  • Companies that provide business related Personal Information to supplement what we already know about you, including data aggregators. Certain third parties might link your name or email address to other information they have collected.

By Combining Information. We may combine your Personal Information from various sources in the following ways:

  • Combine Personal Information that we collect offline with Personal Information we collect through our Website.
  • Combine Personal Information that we collect about you from the different devices you use to access our Website.
  • Combine Personal Information we receive from third parties with Personal Information we already have previously collected about you.

HOW WE USE YOUR PERSONAL INFORMATION

Perficient collects Personal Information for “business purposes” which refers to a business’s operational purposes, or other notified purposes, provided the use of Personal Information is reasonably necessary and proportionate to achieve the operational purpose for which the Personal Information was collected or another operational purpose that is compatible with the context in which the Personal Information was collected.

To Provide Our Products and Services.

We may process your Personal Information in connection with the provision of Services. We may communicate with you about your account or our relationship.

Legal Basis for Processing
Processing is based on our contractual obligations to, or in anticipation of possible future contractual obligations to your employer.  Without your Personal Information, we may be unable to fulfill certain current or future contractual obligations.

To Improve Our Products and Services. 
Purpose of Processing
We may use your Personal Information to make our Website, products and services better. We may also use your Personal Information to customize your experience with us, including the use of our Website.

Legal Basis for Processing
Processing is based on our legitimate interest to better understand you and your employer, to maintain and improve the accuracy of the information we store about you, and to better promote or optimize our Services. Without your Personal Information, your experience with our Website may not be optimized.

To Respond to Your Requests or Questions. 
Purpose of Processing
We may process your Personal Information if you contact us with questions, concerns, requests to opt out of future communications or delete your Personal Information, feedback or to file a complaint.

To Review Your Application for Employment. 
Purpose of Processing

We may process your Personal Information if you apply for a job through our Website.

Processing is based on our legitimate interest in evaluating your application.  Without your Personal Information, we are unable to consider your application for employment.

To Fulfill Employment Related Obligations.
Purpose of Processing
We process our employees’ and subcontractors’ Personal Information in various ways to fulfill legal obligations and operational needs.

Legal Basis for Processing
Processing is based on our legitimate interest in employment and related business operations. Without your Personal Information, we are unable to employ you.

For Marketing.
Purpose of Processing
We may process your Personal Information to inform you about our Services, new industry developments, relevant information in the industries we serve and our marketing events (including by electronic means, such as email). To do so we may process your contact information or information about your interactions on our Services to send you marketing communications; provide you with information about events, webinars, or other materials; and keep you updated about our Services.

We (along with third party partners) may engage in targeted advertising using Personal Information gathered across multiple websites, devices, or other platforms to serve you relevant advertising on our Website or on social media platforms, or other sites, services and mobile applications or on other devices you may use.

Certain information used for targeted advertising is collected through cookies or similar tracking technologies on our Website and third-party websites/platforms and may utilize a common account identifier (such as an email address or user ID) or hashed data to help identify you across devices or serve you ads.

Processing is based on our legitimate interest in providing you with information related to our Services and industry we believe are relevant to you and your employer. Without your Personal Information, we may be unable to provide you with information that you and your employer may be interested in.

For Security Purposes. 
Purpose of Processing
We may process your Personal Information in connection with data security (e.g., to combat spam, malware, malicious activities or security risks; improve existing security measures) or to ensure that unauthorized individuals cannot access your Personal Information we process.

Legal Basis for Processing
Processing is necessary for compliance with our legal obligations, the public interest, and to protect your Personal Information. Without your Personal Information, we may be unable to ensure the security of our Website and services.

As Otherwise Permitted by Law. 
Purpose of Processing
We may also from time to time use your Personal Information in other legally permissible methods. This Policy will be updated if necessary.

WHEN WE MAY SHARE YOUR INFORMATION

Perficient does not sell, exchange, transfer, or provide your Personal Information to any third parties except as set forth below:

Internally. As a global organization, Perficient may share your information with its offices and data centers throughout the world to provide our Services (e.g., the United States, Europe, Latin America, and Asia) and marketing purposes.

With Your Consent. We may display Personal Information you post on our social media accounts. Perficient may also disclose your information to a third party if you have given us your consent to do so or Perficient is required to do so to perform contracted Services.

With Our Service Providers. We may share your Personal Information with third parties who perform services on our behalf so that they can assist us with the maintenance of our Services or delivery of targeted advertising. Our contracts with these service providers prohibit them from sharing your Personal Information with others for other purposes than as directed by us.

With Our Business Partners. We may share your Personal Information with a third party that co-sponsors a survey or webinar.

For Business Transactions or Reorganizations. We may take part in or be involved with a corporate business transaction, such as a merger, acquisition, joint venture, or financing or sale of all or a portion of our company assets, and as part of such transaction, we may disclose Personal Information to a third-party during the applicable negotiations. Personal Information may also be disclosed in the event of insolvency, bankruptcy, or receivership. Except as otherwise provided by a bankruptcy or other court, the use and disclosure of all Personal Information will be subject to policies that are consistent with the policies described in this Policy. However, any Personal Information that is submitted or collected after that transfer may be subject to a new privacy policy adopted by the successor entity.

To Comply with the Law or To Protect Ourselves or Third Parties. For purposes of responding to a court order or subpoena or sharing Personal Information at the request of a government agency or investigatory body. Perficient may use, share, or disclose information about you in order to address legal concerns or liabilities, especially when we believe, in our sole discretion, that (a) you might have misused the Services, such as to gain unauthorized access to any system, engaged in spamming, denial of service attacks, or similar attack; (b) disclosure is reasonably necessary to enforce our Terms of Use; (c) to respond to suspected illegal or fraudulent activity; (d) to protect legal rights or defend against legal claims; (e) to allow us to pursue available remedies or limit the damages that we or a third party may sustain.

For Other Reasons We May Describe to You. This Policy will be updated if necessary.

YOUR RIGHTS REGARDING YOUR PERSONAL INFORMATION

You have the following rights (subject to certain exceptions) regarding your Personal Information that may be held or otherwise processed by Perficient. Perficient will act on all requests as soon as reasonably practicable and will not discriminate against you for exercising any of these rights.  Perficient may ask you to verify Personal Information we already have on file for you to confirm your identity. If Perficient cannot verify your identity based on the information on file, you may be asked to provide additional information to verify your identity, and for security or fraud-prevention purposes. 

Opt Out of the Sale or Sharing of Your Personal Information (including Targeted Advertising)
Based on the definition of sales under relevant regulations, Perficient does not engage in sales of Personal Information, but may share your Personal Information as explained above.  You have the right to opt out of the sharing of your Personal Information (including targeted advertising) by contacting us at privacy@perficient.com and clearly stating the nature of your request. 

Opt Out of Marketing Communications
You have the right to opt out of Perficient’s marketing communications at any time by using the unsubscribe links or instructions included at the bottom of our emails, or by contacting us at  privacy@perficient.com and clearly stating the nature of your request.

You may still receive non-marketing communications from us if Perficient is actively performing Services for your employer, if you have applied for employment with Perficient, or are a current employee.

Right to Know How We Process Your Personal Information
You have the right to request confirmation from Perficient regarding whether and to what extent Perficient is processing your Personal Information, by contacting us at privacy@perficient.com
 and clearly stating the nature of your request. 

You may also have the right to request in writing: (i) a list of the categories of Personal Information, such as name, address, email address, that a business has disclosed to third parties during the immediately preceding calendar year for the third parties' direct marketing purposes, and (ii) the names and addresses of all such third parties. In addition, you have the right to request: (i) the categories of Personal Information we have collected about you, (ii) the categories of sources from which Personal Information is collected, (iii) the business or commercial purpose for the information collection, (iv) the categories of third parties with whom we have shared Personal Information, and (v) the specific pieces of Personal Information we hold about an individual.

Right to Object to Processing and/or Revoke Prior Consent
You have the right to object to the processing of your Personal Information and/or to revoke any previous consent you have given Perficient to process your Personal Information by contacting us at privacy@perficient.com and clearly stating the nature of your request.

Right to Modify or Erase Your Personal Information
You have the right to request modifications to or the deletion/erasure of your Personal Information by contacting us at privacy@perficient.com and clearly stating the nature of your request.

Right to Access a Copy of Your Personal Information
You have the right to request a copy of the specific Personal Information Perficient collected about you during the 12 months before your request by contacting us at privacy@perficient.com and clearly stating the nature of your request.

This Personal Information will be provided in a structured and standard format and, where technically and legally feasible, you may also have the right to have your Personal Information transmitted directly to a third-party.

Right to File Complaint with Supervisory Authority
If you believe Perficient has infringed or violated your privacy rights, we encourage you to contact us directly at privacy@perficient.com. Depending on your state or country of residency or the place of alleged infringement of your rights, you may also have a right to lodge a complaint directly with a competent supervisory authority.
California residents may also make any of the above requests using an authorized agent. To make a request on behalf of a California resident whose personal information has been collected by Perficient, the authorized agent must first provide a copy of either (a) a letter signed by the customer authorizing the agent to submit a CCPA request on his or her behalf, or (b) a valid power of attorney issued pursuant to California Probate Code sections 4000 to 4465. An authorized agent must email one of these documents to privacy@perficient.com and include a phone number where the agent may be reached during regular business hours.

HOW WE PROTECT YOUR PERSONAL INFORMATION

Perficient understands the importance of keeping your personal information. While no security system or data storage or transmission over the Internet or otherwise is fully secure, Perficient uses reasonable technical, organizational, and administrative measures to reduce the risk of unauthorized or unlawful access or processing, and against accidental loss, destruction, or damage to your information. We believe that these measures are reasonably adapted to the nature of the information in our custody. In addition to the security measures detailed above, Perficient protects your Personal Information by taking measures: (i) to protect the ongoing confidentiality, integrity, availability, and resilience of our processing systems and services; (ii) to restore the availability of and access to Personal Information in a timely manner in the event of a physical or technical incident; and (iii) to regularly test, assess, and evaluate the effectiveness of our technical and organizational measures. COOKIES AND OTHER TRACKING TECHNOLOGIES

Like other websites, Perficient’s Website may store or retrieve information on your browser, mostly in the form of cookies. This information might be about you, your preferences or your device and is mostly used to make the site work as you expect it to. The information does not usually directly identify you, but it can give you a more personalized web experience. Because Perficient respects your right to privacy, you can choose not to allow some types of cookies. Keep in mind that blocking some types of cookies may impact your experience of the site and the services we are able to offer.

Social Media Cookies: These cookies are set by a range of social media services that we have added to the Website to enable you to share our content with your friends and networks. They are capable of tracking your browser across other sites and building up a profile of your interests. This may impact the content and messages you see on other websites you visit. Targeting Cookies: These cookies may be set through our site by our advertising partners. Functional Cookies: These cookies enable the Website to provide enhanced functionality and personalization. They may be set by Perficient or by third party providers whose services we have added to our pages. If you do not allow these cookies then some or all of these services may not function properly.

Strictly Necessary Cookies: These cookies are necessary for the Website to function and cannot be switched off in our systems. They are usually only set in response to actions made by you which amount to a request for services, such as setting your privacy preferences, logging in or filling in forms. You can set your browser to block or alert you about these cookies, but some parts of the site will not then work. These cookies do not store any personally identifiable information.

Performance Cookies: These cookies allow us to count visits and traffic sources so we can measure and improve the performance of our Website. They help us to know which pages are the most and least popular and see how visitors move around the site. All information these cookies collect is aggregated and therefore anonymous. If you do not allow these cookies we will not know when you have visited our site, and will not be able to monitor its performance.

Do Not Track 
Some browsers have “do not track” features that allow you to tell a website not to track you. Because these features are not all uniform Perficient’s Website does not currently have a way to respond to those signals. 

Google Analytics and Advertising Preferences
Perficient’s Website uses Google Analytics to better understand how our visitors interact with our Website. For information on how Google Analytics collects and processes data, as well as how you can control information sent to Google, review Google's site “How Google uses data when you use our partners' sites or apps” located at https://policies.google.com/technologies/partner-sites.

You may also control your Google advertising preferences by visiting the Google Ads Preferences Manager, currently available at https://google.com/ads/preferences.  The Network Advertising Initiative (NAI) offers additional opportunities to control your advertising preferences with certain NAI members. Tracking Technology in Emails
Perficient may also use certain email tracking technology in its marketing emails to determine whether a recipient has opened an email or clicked a link in an email.  As explained above, You have the right to opt out of Perficient’s marketing communications at any time by using the unsubscribe links or instructions included at the bottom of our emails, or by contacting us at privacy@perficient.com and clearly stating the nature of your request.  

STORAGE AND RETENTION

Perficient is a global company and may store your Personal Information in or outside of the United States. Individuals who reside outside of the United States should be aware that we may transfer your Personal Information to the United States. 

Perficient will retain your Personal Information as necessary to: perform the activities described in this Policy; for as long as we have an ongoing relationship with you, to provide services to you, and to comply with our global legal, contractual, regulatory, accounting or reporting requirements which inform our records retention policy. Subject to certain exceptions, you also have the right to request erasure of your Personal Information as explained in above. 

ADDITIONAL PRIVACY INFORMATION

Links to Third-Party Services
Perficient’s Website, marketing communications, and social media accounts may contain links to other third-party sites, applications or other online services. If you click on a link to a third-party site or other online service, you will be taken to a site or other online service we do not control and that is not governed by this Policy. Perficient is not responsible for the privacy practices used by third-party sites and other online services and strongly suggests that you read the privacy policies of those sites and other online services carefully.

Children Under 16

Our Website is intended for adults. We do not knowingly collect or solicit any information from anyone under the age of 16 though our Website. If we learn that we have inadvertently collected Personal Information from a child under age 16, we will delete that information as quickly as possible. If you believe that we might have collected Personal Information from a child under 16, please contact us at privacy@perficient.com.

International Data Transfers (Non-US Residents)
This section only applies to individuals residing outside the United States.  As a global organization, Perficient may store, process and transmit Personal Information in locations around the world, including locations outside of the country or jurisdiction where you are located. Perficient only sends Personal Information within a restricted legal framework, such as e.g. the European Economic Area (EEA) or Asian Pacific Economic Cooperation (APEC), to

  • follow your instructions;
  • comply with a legal duty; or
  • work with our agents and advisers who we use to help run our business and services.
If we do transfer Personal Information outside of the restricted legal framework, Perficient will make sure that it is protected in the same way as if it was being used in that restricted legal framework. We will use one of the following safeguards:

  • transfer to another country whose privacy legislation ensures an adequate level of protection of Personal Information similar or equivalent to the country it was collected in; or
  • put in place a contract with the third-party that means they must protect Personal Information to the same standards as in the country the data was collected in.
